Terms of Use

These terms form an agreement between you and [LEGAL ENTITY NAME] about your use of the Network Test application for Android. By installing or using the app you accept them. If you do not accept them, do not use the app.

Two things worth knowing up front

1. The licence we grant you

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own purposes. We keep every right not expressly granted here.

2. What the app does

Network Test examines your Wi-Fi connection and your cellular connection separately and gives each a score, along with a combined score. Depending on conditions, permissions and whether a measurement server is reachable, it may report radio information only, performance only, or both. A score shown as N/A means the app could not measure enough to state one — it does not mean the network is bad.

3. Data usage and charges

Measuring throughput requires transferring real data. On cellular, that consumes your data allowance and may incur charges from your mobile operator, including roaming charges when you are abroad. The app limits how much it will transfer on cellular and shows an estimate before the first run, but you are solely responsible for any charges your carrier applies. Check your plan before testing on a metered or roaming connection.

You agree not to:

Measuring a network you do not own or administer may be restricted where you live or by the policies of the network's owner. Making sure your use is lawful is your responsibility.

5. Ads, the paid version and codes

The app is free and supported by advertising. You may remove ads by making a one-time in-app purchase, or by redeeming a code we issue.

6. Third-party services

The app relies on Google Play services, Google AdMob and — for performance tests — measurement servers that may be operated by us or by third parties. We are not responsible for those services, their availability, or their terms. Your use of them is governed by their own agreements.

7. Availability and changes

We may change, suspend or discontinue the app or any part of it, including server-dependent features, at any time and without notice. We have no obligation to provide support, updates or continued availability of any measurement server.

8. Intellectual property

The app, its name, its design, its scoring method and all related materials are owned by us and protected by intellectual property law. Nothing in these terms transfers ownership to you. The test results your device produces are yours.

9. Privacy

Our handling of data is described in the Privacy Policy, which forms part of these terms.

10. Termination

This licence ends automatically if you breach these terms. You may end it at any time by uninstalling the app. Sections 3, 8, 11, 12 and 13 survive termination.

11. No warranty

The app is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any measurement it produces is accurate or complete.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot lawfully be limited.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for loss of data, loss of profits, loss of business, or data charges levied by your mobile operator, arising from your use of or inability to use the app — even if we were advised that such damages were possible.

Where liability cannot be excluded, our total aggregate liability to you is limited to the greater of the amount you actually paid for the app in the twelve months before the claim, or USD 10.

13. Governing law

These terms are governed by the laws of [JURISDICTION — e.g. the State of Israel], without regard to conflict-of-law rules. The courts of [CITY / JURISDICTION] have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring proceedings where you live.

14. Changes to these terms

We may revise these terms. The revised version will be posted here with a new date, and continued use of the app after that date constitutes acceptance. If you do not accept a revision, stop using the app.
